On 23 May 2022, CENECO received a Notice of Resolution issued by the Energy Regulatory Commission (ERC) in ERC Cases 2012-003CF, 2015-024CF and 2018-018, or simply known as CENECO’s (Over)/Under Recovery Applications for the years 2004 to 2017. The said notice informed CENECO of the decision reached by the ERC last 26 January 2022, with a resulting net total over-recoveries amounting to P237,949,425.51, and a directive for CENECO to implement the refund. The said notice provides that the official Decision [in said cases] shall be issued or promulgated shortly.

To date, CENECO has not yet received the formal decision from ERC. Such being the case, CENECO filed a manifestation with a motion to defer implementation of the refund pending receipt of the official decision from ERC. Without the official Decision from the commission, CENECO is constrained to stay the implementation of the refund as only a final decision, order or resolution that is officially rendered in accordance with the ERC Rules of Practice and Procedure can be immediately implemented even pending appeal.
